The expansion of extractive corporations’ overseas business operations has led to serious concerns regarding human rights–related impacts. As theseapprehensions grow, we see a countervailing rise in calls for government intervention and in levels of socially conscious shareholder advocacy. I focus on the latter as manifested in recent use of the shareholder proposal mechanism found in corporate law. Shareholder proposals, while under-theorized, provide a valuable lens through which to consider the argument that economic behaviour is embedded within social relations. In doing (...) so, I situate my analysis within Third World Approaches to International Law (TWAIL) scholarship. Elsewhere, I have supported the use of corporate law tools in advancing the international human rights enterprise and argued that investment activism can be an essential component of this advancement. This paper represents a reflexive pause. Using the case study of a recent proposal submitted to Goldcorp Inc., I seek to problematize the shareholder proposal as a human rights advocacy tool and to examine it as a site of contestation. "Republicanism" in Kant's political philosophy describes the type of state and the kind of politics demanded by freedom. Thus understood, republicanism expresses the limits of practical reason in politics. ;Kant sets his political thought against Hobbes' empirical description of political individuals, for whom norms arise through imaginative "picturing" of various conditions. For Kant free practical subjects are motivationally independent of sensed objects and possess ability for self-legislation . Kant further maintains that ideas are "regulative", not constitutive, of human understanding, such (...) that correct use of them requires knowledge of their "principles." ;Because autonomy governs internal determinations, it cannot be the principle of republicanism, which as a matter of "right" concerns actions in their external aspect alone. Actions are subject only to moral possibility, or "permission". Kant's "permissive law" can be understood as law only if moral obligation is distinguished from the specification of duty, a distinction drawn by Achenwall, who influenced Kant. Right built on "permission" connects "first taking" and "intelligible possession". This explains two notions permeating Kant's political writings: obedience to state authority as such, and skepticism regarding any identification of existing arrangements with the idea of a perfectly rightful state. ;Thus conceived, right legitimizes various constitutions. The republican idea and its principle of "representation" are civil elaborations of permission's skeptical aspect. State authority represents the "universal united will", and cannot legitimately be resisted. ;This interpretation faces two challenges. One is unreserved cosmopolitanism, the claim that no right is conclusive without global authority. However, this position misinterprets "permission" as a preliminary violation of right, and therefore not as law. Secondly, the state may be seen as "rightfully" constituted for "fairness". This mistakenly attributes to Kant a Hobbesian view of individuals, and employs ideas not according to their principles , but in a direct, "pictorial" manner . ;Kant's "republicanism" is not an institutional arrangement but a principle of governance. The republican idea is the condition of the possibility of gradual, nonrevolutionary progress. Kant's "permission"---through its lack of specification and its deference to existing authority---is the expression of freedom in external contexts and the foundation of properly critical politics. A study was done with incoming freshmen, sophomore, senior, and graduate business students (n = 185) to assess the effects of moral development, gender, education level, and context on the moral choices in a simulated business situation, a potential hostile takeover of a fictional company. The results indicated that level of moral development did affect the decisions of students; however, main effects for gender, the level of education, and context were not significant. Theresults did find significant interaction effects between context (...) and moral development and gender and moral development. Students with lower levels of moral development were less likely to consider the contextual situation when making their decisions. The effect of moral development was more pronounced for female business students than for male business students. Abstract:Hume described himself as an Academic skeptic and aligned himself with the skepticism of Socrates and Cicero. I argue, though, that Hume transformed the meaning of Academic skepticism by associating it with an experimental rather than dialectical method. In this essay, I distinguish between those aspects of Cicero’s Academic skepticism that Hume adopted and those he discarded in his presentation of mitigated skepticism in the first Enquiry. I then consider the implications of Hume’s transformation of Academic skepticism for Hume’s polite (...) eloquence in the Essays, particularly the essays on happiness, which are often described as possessing “Ciceronian” and “dialectical” elements. The theological turn in French phenomenology has been of great interest to scholars working in contemporary continental thought, but according to J. Aaron Simmons, not enough has been done to bring these debates into conversation with more mainstream philosophy. Building on the work of Kierkegaard, Levinas, Marion, and Derrida, among others, Simmons suggests how continental philosophy of religion can intersect with political philosophy, environmental philosophy, and theories of knowledge. Kyle Stanford has recently given substance to the problem of unconceived alternatives, which challenges the reliability of inference to the best explanation (IBE) in remote domains of nature. Conjoined with the view that IBE is the central inferential tool at our disposal in investigating these domains, the problem of unconceived alternatives leads to scientific anti-realism. We argue that, at least within the biological community, scientists are now and have long been aware of the dangers of IBE. We re-analyse the nineteenth-century (...) study of inheritance and development (Stanford’s case study) and extend it into the twentieth century, focusing in particular on both classical Mendelian genetics and the studies by Avery et al. on the chemical nature of the hereditary substance. Our extended case studies show the preference of the biological community for a different methodological standard: the vera causa ideal, which requires that purported causes be shown on non-explanatory grounds to exist and be competent to produce their effects. De-extinction technology aims to bring extinct species back into existence, often with the goal of releasing created organisms into natural environments. In this paper, I argue that there are aesthetic reasons to avoid engaging in de-extinction and release projects, even if they pass moral permissibility criteria. The strength of these reasons depends on conclusions regarding species authenticity - a problem that arises at the intersection of de-extinction technology and the 'species problem' in the philosophy of biology. Since species authenticity affects (...) the perceived naturalness of 'natural' environments, and thus the aesthetic judgments thereof, I contend that there will be negative aesthetic consequences of de-extinction efforts that ought to be further explored before such projects move forward. However, in line with Hent de Vries and in contrast to Dominique Janicaud, I contend that there are reasons for taking continental God-talk seriously on purely philosophical grounds. On this basis, I then go on to advocate a specific form of God-talk-that dealing with kenosis-as being deeply relevant to contemporary politics because of the way in which it provides an argument (...) for democracy as the political system best opened to the critical function of charity. Task-unrelated thought (TUT) occurs frequently in our daily lives and across a range of tasks, but we know little about how this phenomenon arises during and influences the way we communicate. Conversations also provide a novel opportunity to assess the alignment (or divergence) in TUT during dyadic interactions. We conducted a study to determine: (a) the frequency of TUT during conversation as well as how partners align/diverge in their rates of TUT, (b) the subjective and behavioral correlates of TUT and (...) TUT divergence during conversation, and (c) if perceived social group identity impacts TUT and TUT divergence during conversation. We used a minimal groups induction procedure to assign participants (N = 126) to either an ingroup, outgroup, or control condition. We then asked them to converse with one another via a computer-mediated text chat application for 10 min while self-reporting TUTs. On average, participants reported TUT about once every 2 min; however, this rate was lower for participants in the ingroup condition, compared to the control condition. Conversational pairs in the ingroup condition were also aligned more in their rates of TUT compared to the outgroup condition. Finally, we discuss subjective and behavioral correlates of TUT and TUT divergence in conversations, such as valence, turn-taking ratios, and topic shifts. (shrink)

Although there is wide agreement that ethics consults are at risk for conflicts of interest, ethics consultants have limited guidance with regard to how to identify and approach COIs. We aim to address these concerns and provide practical guidance. We will define and consider four categories of COIs: consult type, team composition, dual clinical roles and other concerns. We will define and consider six actions available for ECs to take in response to COIs: no action, disclosure only, obtaining a second (...) opinion, referring to another EC, referring to an institutional ethics committee or seeking an outside consult. We will then propose a points-based algorithm for ECs to use to determine the appropriate response to COI. Finally, we will discuss the strengths and limitations of our proposed algorithm. (shrink)

Velmans’ paper raises three problems concerning mental causation: (1) How can consciousness affect the physical, given that the physical world appears causally closed? 10 (2) How can one be in conscious control of processes of which one is not consciously aware? (3) Conscious experiences appear to come too late to causally affect the processes to which they most obviously relate. In an appendix Velmans gives his reasons for refusing to resolve these problems through adopting the position (which he labels ‘physicalism’) (...) that ‘consciousness is nothing more than a state of the brain’. The rest of the paper, then, is an attempt to solve these problems without embracing a reductionist physicalism. Velmans’ solution to the first problem is ‘ontological monism combined with epistemological dualism’: First-person and third-person accounts are two different ways of knowing the same facts. This kind of reply is not new; it is, for example, a twist on the position expressed in Davidson (1970). True, there are substantial differences: For one, Davidson reconciles the tension between descriptions of events in mentalistic and physicalist language, not between firstand third-person descriptions of states; for another, Davidson actually provides an argument for his position, although to do so he assumes that there are no psycho-physical (or indeed, psycho-psycho) laws, something which I suspect Velmans would be reluctant to do. Nevertheless, they have in common the idea that the causal efficacy of the mental is not at odds with the causal closure of physics, since a mind-involving causal story is just another way of talking about the same facts that a purely physical causal story talks about. This ‘dual-aspect’ approach is a popular tactic for resolving the mind--body problem, but it has some well-known problems, and it is unfortunate Velmans doesn’t reply to these standard objections. For example, a frequently discussed issue in connection with theories of mental causation is the problem of overdetermination (see, e.g., Unger, 1977; Peacocke, 1979). (shrink)

We are fortunate to have commentators that are (...) so much in sympathy with what we have written.The comments of Castelfranchi and Miceli draw attention to a problem that we expect many readers to bring up, namely that there is a notion of “information processing” that cannot carry the explanatory weight that we attach to our information processing architecture. We believe that there is a concept of “information processing” such as is used by engineers who design software systems to perform such tasks as controlling an aircraft. We claim that within an appropriate system architecture, information processing states can have all the causal powers that we require for states like pain, pleasure, and the like. However this is not obvious, and defending this claim will have to await another occasion.Lloyd helpfully illustrates the relevance of our proposed architecture even to the effects of imagining the death of a loved one. He also makes the useful observation that second-order states can arise when a person who is suffering because events violate some important motivator, discovers that nothing can be done about the cause of the suffering, and then suffers even more because of feeling helpless in that situation. Cuckoldry is an adaptive problem faced by parentally investing males of socially monogamous species (e.g., humans and many avian species). Mate guarding and frequent in-pair copulation (IPC) may have evolved as anti-cuckoldry tactics in avian species and in humans. In some avian species, the tactics are used concurrently, with the result that mate guarding behaviors and IPC frequency are correlated positively. In other avian species, the tactics are compensatory, with the result that mate guarding behaviors and IPC frequency are correlated (...) negatively. The relationship between mate guarding and IPC frequency in humans is unknown. Avian males that use these tactics concurrently share with human males an inability to guard a female partner continuously during her peak fertile period. We hypothesized, therefore, that men’s mate guarding and IPC frequency function as concurrent anti-cuckoldry tactics, resulting in a positive correlation between them. Study 1 (n=305) secured men’s self-reports of mate guarding and IPC frequency. Study 2 (n+367) secured women’s reports of their partners’ mate guarding and IPC frequency. The concurrent tactics hypothesis was supported in both studies: Men’s mate guarding and IPC frequency are correlated positively, and this association is not attributable to male age, female age, relationship satisfaction, relationship length, or time that the couple spends together. The concept of difference has a long and important research tradition. We identify and explicate a heretofore overlooked distinction in the meaning and measurement of two different meanings of 'difference': 'diversity' and 'heterogeneity'. We argue that ‘diversity’ can describe a population well enough but does not describe a collective well. In contrast, ‘heterogeneity’ describes a collective better than a population and therefore ought to describe a collective. We argue that ignoring these distinctions can lead to a surprising and disturbing conflict (...) between diversity and heterogeneity. In particular, focusing on the 'diversity' of human communities can be self-defeating for those who truly care about the importance of diversity, inclusion, and belonging. (shrink)

A number of barriers in the health care and drug regulatory systems account (...) for the gap between what is known about pain management and what is practiced. Among the barriers are physicians’ fears of being disciplined by state regulatory boards for inappropriate prescribing.State medical boards are in a unique position not only to address physicians’ concerns about being investigated, but also to encourage pain management. It highlights the interdisciplinary approach taken in the choice of contributors to the volume which it is hoped will result in new perspectives on the philosophy of the Scottish Enlightenment. The chapter notes that the contributors approach Hutcheson, Hume, Smith, and Reid from new points of view, and other important figures and philosophical themes are discussed in terms of their contributions to a distinctively Scottish philosophical (...) scene in the eighteenth century. In this discussion piece we address how the UK government has attempted to manage public expectations of a proposed biometric identity scheme by focussing attention on the handheld, i.e., the ID card. We suggest that this strategy of expectations management seeks to downplay the complexity and uncertainty surrounding this high-technological initiative, necessitating the selective use of expertise for the purpose of furthering government objectives. In this process, government often relegates counterexpertise, if not dismissing it outright, thereby greatly politicizing the policy (...) deliberation process. We argue that this manoeuvring by government spells trouble for both democratic deliberation on the issue of biometric identification in the UK and, more generally, expertise-based policy making in related technological ventures. Drug Safety Communications are used by the Food and Drug Administration to inform health care providers, patients, caregivers, and the general public about safety issues related to FDA-approved drugs. To assess patient knowledge of the messaging contained in DSCs related to the sleep aids zolpidem and eszopiclone, we conducted a large, cross-sectional patient survey of 1,982 commercially insured patients selected by stratified random sampling from the Optum Research Database who had filled at least two prescriptions for either zolpidem or eszopiclone (...) between July 1, 2012 and June 30, 2013. Among the 594 respondents, two-thirds reported hearing generally about drug safety information prior to starting a new drug, with the remaining one-third “rarely” or “never” hearing such information. Providers and pharmacists were primary sources of drug safety information. Two-thirds of zolpidem users and half of eszopiclone users reported having heard about the related DSC messages, ability to accurately identify the major factual messages was limited. Respondents reacted to new drug safety information about their sleep aids by reporting that they would want to learn about alternative ways to help them sleep and seek out more information about the safety of their specific sleeping pill. Opportunities may exist for the FDA to work with providers and pharmacies to help ensure the DSC information is more widely received and is more fully understood by those taking the affected medications. We ride alongside the characters as they strive for the ideals that make life worth living, such as friendship, love, and happiness, though none of the characters seems to have achieved these ideals perfectly in their lives. Online data collection methods are expanding the ease and access of developmental research for researchers and participants alike. While its popularity among developmental scientists has soared during the COVID-19 pandemic, its potential goes beyond just a means for safe, socially distanced data collection. In particular, advances in video conferencing software has enabled researchers to engage in face-to-face interactions with participants from nearly any location at any time. Due to the novelty of these methods, however, many researchers still remain uncertain about (...) the differences in available approaches as well as the validity of online methods more broadly. In this article, we aim to address both issues with a focus on moderated data collected using video-conferencing software. First, we review existing approaches for designing and executing moderated online studies with young children. We also present concrete examples of studies that implemented choice and verbal measures and looking time across both in-person and online moderated data collection methods. Direct comparison of the two methods within each study as well as a meta-analysis of all studies suggest that the results from the two methods are comparable, providing empirical support for the validity of moderated online data collection. Finally, we discuss current limitations of online data collection and possible solutions, as well as its potential to increase the accessibility, diversity, and replicability of developmental science. Glenberg's theory is rich and provocative, in our view, but we find fault with the premise that all memory representations are embodied. We cite instances in which that premise mispredicts empirical results or underestimates human capabilities, and we suggest that the motivation for the embodiment idea – to avoid the symbol-grounding problem – should not, ultimately, constrain psychological theorizing.

Biological evolution allegedly requires a genealogical conception of species (i.e., that species are descent-based "historical entities" rather than similarity-based "natural kinds"). After considering David Hull's arguments for this view, this paper opts instead for individuating species primarily via genetic similarities, but in a way which avoids charges of "Essentialism". It is suggested that a genealogical conception of species actually derives from a biological version of Behaviorism plus an interrelated pair of confusions regarding evolution and identity. Current taxonomic method may favor (...) the genealogical conception, but evolutionary theory-- as well as genetics and molecular biology--count against it. (shrink)
